Chapter 13

New York Chapter 13 Bankruptcy Attorney

Once the decision to file bankruptcy is made, it is a wise decision to consult with an experienced Rochester Chapter 13 attorney to determine the best course of action.

At the Law Offices of George Mitris, my staff and I work to learn as much about the financial situations of our clients as possible. We understand that every situation is different, and each client will need different help. I make sure to educate my clients on the legal process and the pros and cons of filing for bankruptcy. Armed with information, I help my clients make the best decisions for their unique difficulties.

It is important to note several factors about Chapter 13 filing, including:

  • Chapter 13 is a debt restructuring plan.
  • Chapter 13 is most often used to save homes, autos and other personal property. along with curing mortgage arrears, lowering auto payments, eliminating or reducing interest, chapter 13 also allows you to reduce or virtually eliminate unsecured debt. Chapter 13 can also eliminate liens against your property, such as judgments, and even some mortgages can be eliminated. Or if you simply want to pay your debt, but cannot afford the high rates of interest, charges, or payments, you can propose a plan that only pays what you can afford, the possibilities are numerous. The repayment amount and the monthly amount are tied directly to your disposable income. That is, you only pay what you can afford.
  • The repayment period is for three to five years.
  • Once the repayment period has been successfully completed, most if not all of the remaining unsecured debt will be discharged.
  • A Chapter 13 filing can stop a foreclosure.
  • In some situations, a Chapter 13 filing can eliminate a second mortgage.
  • In many situations, you can choose what bills to include in the repayment and what assets to keep.

New York Consumer Bankruptcy Lawyer

For many individuals, Chapter 13 might be a great way of repaying or reorganizing debts. In many cases, clients can repay with much lower overall payments than they originally had and pay off their debts. The courts take a good look at your finances and set up your total and monthly repayment amounts based on what you can actually afford. Many clients of mine feel an immediate sense of relief after filing for bankruptcy. They know that it’s time for a fresh start.

Chapter 7

New York Chapter 7 Bankruptcy Attorney

Are you facing mounting credit card debt? Have your medical bills spiraled out of control? Do you struggle to make your mortgage or personal loan payment each month? If so, you should seek the counsel of an experienced Rochester Chapter 7 attorney to learn about how bankruptcy can help you regain control of your finances.

I am George Mitris, and I have experience guiding clients through personal bankruptcy as well as small business bankruptcy. As a New York lawyer, I have gained a great deal of skill and knowledge through all facets of bankruptcy. Not every situation is the same, and each client has specific challenges that he or she must deal with. My background helps me look at each dilemma and develop an effective strategy to deal with it.

There are some common facts about a Chapter 7 filing that many clients find helpful, including:

  • Chapter 7 works to eliminate most or all of your unsecured debt.
  • There is no repayment plan.
  • A Chapter 7 filing stops creditor harassment via the automatic stay.
  • Debt collection attempts, including lawsuits, and wage garnishments must stop immediately following a Chapter 7 filing.

There are misconceptions about the facts and consequences about the various chapters, and about how a bankruptcy filing can change your life for the positive or negative. With this in mind, my staff and I take a great deal of time to provide as much information as possible based on the client’s specific factors and circumstances. With this information, and after an organized look at the client’s finances, we can effectively guide them through a determination of which bankruptcy filing, if any, meets his or her needs.
